WakeUpNow (WUN) Lawsuit Vs. Former CEO Kirby Cochran?

On February 4th, 2015 Kirby Cochran filed for bankruptcy in Utah… how about that timing? Lol.

I also went to his brothers Facebook page to look for the post they were talking about in the article.

This was a public status that Gary Cochran posted on January 20th, 2015:

“What are brothers for?

I just read some outlandish lies and fraudulent posts that are being disseminated across the Internet that concern my brother, Kirby Cochran. It has not been my nature to respond to Internet behavior that borders on the obscene and criminal, but I can’t stand by and not refute the distorted information that is being posted about a person I respect and love – my brother Kirby Cochran.

I came across a post that states that Kirby and two other gentlemen who I know extremely well are “con men.” This is absolutely false. The article states that Kirby defrauded his previous business partners and companies out of millions of dollars. The person who wrote this malicious lie is referring to Kirby’s tenure as CEO of the network marketing company known as “WakeUpNow.”

Let me put the record straight. Kirby was in fact the CEO of that company and invested a great deal of his own money, and because of his vision I had also invested thousands of dollars myself. Kirby came to me and asked if I would be willing give a short-term loan to the company of almost $400,000 in September of 2014. Because of my knowledge of Kirby’s integrity and honesty, I agreed to loan the company $371,000 on a short-term basis. There is no way I would have loaned the company the money if I had known that other key management executives were planning on doing a takeover of the company and forcing Kirby out of the company. Even with a signed promissory note from WakeUpNow, the company continues to refuse to pay back one single penny. In my mind these individuals and WakeUpNow stole almost $400,000 of my money. As far as fraud and theft go, WakeUpNow need go no further than their front door.

Kirby has agreed to work with another company and use his expertise and skills to provide true opportunities for entrepreneurs across the globe. I for one have made the decision to join him in whatever business venture he takes. Over the past years I have watched and joined him as he created opportunities that improved my life and that of many of my friends. Kirby has helped to enhance my life both personally and financially. But I’m not alone as a person who has benefited from Kirby’s advice. I have a number of friends and associates who have all benefited greatly from the honest business practices of Kirby. And when you add the integrity of people like Dr. Michael Wach and the South American Entrepreneur, Adam Rosales, you have three honest men.

The dishonest people and their minions behind these slanderous and criminal statements should be ashamed of themselves. If I can’t state the truth and defend an honest man, what are brothers for?

I am sure we will all find out after the lawsuit and more comes to light. Just reading that was so crazy… because I met Kirby Cochran and Troy Dooly down in Miami, Florida in July of 2014. I can’t believe all of this happened… I mean I know there is always stuff going on behind the scenes from back door deals, to corporate espionage like this shit… but wow.

What are your thoughts on the whole thing?

So called ‘industry experts’ said that WakeUpNow wouldn’t last years ago… it is starting to look like with all of today’s reports, and almost all of WUN’s top earners stepping down, I highly doubt they are going to pull through.

I wish all of the WUN employees and IBO’s the best of luck… I know a lot of the IBO’s have joined new companies already **cough cough taken $$$ as a contract ** but I hope the little guys who weren’t offered these same deals can find a new network marketing company, and build it organically like the rest of us.

Bill Ackman Believes That Herbalife Will Fail In A Years Time… Where Is The MLM Industry Headed?

Bill Ackman has made yet another claim about Herbalife Ltd. He recently spoke at Saiid Business School at the University of Oxford, talking on the subjects of investing in Herbalife, J.C. Penney Company, Inc. and Canadian Pacific Railway Limited.).

He has said that in all of his investment career, he’s had 24 wins, two losses and only one tie. At this point it’s unclear which category Herbalife falls into.

Here’s What Bill Ackman Had To Say About Herbalife

He once again predicted that Herbalife Ltd (NYSE:HLF) would go bust. This time, he put a time frame on it, although it’s a pretty big time frame.

“I’ll make a prediction,” he told the interviewer. “…This business will be shut down, this business will collapse, I can’t give you the precise date, but we will have made progress in that direction within 12 months.”

Ackman has been attempting to chip away at the company for almost a year now by calling it a pyramid scheme. In the interview at Oxford, he said that the company targets “unsophisticated, unemployed, low income” people, particularly those in immigrant communities. A number of lawmakers and leaders of organizations have come forward along with Ackman to urge regulators to investigate Herbalife, although they haven’t moved on it yet.

Ackman claims 99% of people lose money distributing Herbalife Ltd (NYSE:HLF). He believes there are about 50 people who make $5 million or $10 million a year and just a thousand who make a few hundred thousand a year from Herbalife. He also claims 3.6 million people lose between $300 and $30,000 or more by distributing the company’s products.

So why does Ackman remain convinced that Herbalife Ltd (NYSE:HLF) will collapse? He says it’s simple. He believes pyramid schemes eventually run out of “victims” and then collapse. He notes that the company increased its sales in the U.K. in the last quarter by 92% and said that it has found “a new immigrant population to go after” there.

According to Ackman, people think they have to buy $3,000 in inventory before they start earning royalties. He called it an “inventory loading scheme.” He suggests that it’s only a matter of time before the company runs out of people to target.

Bill Ackman vs Carl Icah: The Feud Continues?

Ackman also called out fellow activist investor Carl Icahn, who he’s been feuding with for a long time. The two hedge fund managers have been facing off over Herbalife Ltd (NYSE:HLF), with Ackman taking a major short position and Icahn going long. After Ackman announced his major short position last December, shares of the company’s shares started falling, but then Icahn got involved.

“So far so good, until Carl Icahn came along and bought 16% of the company,” Ackman told the interviewer. “Said I was totally wrong, and it seems like every day he goes on CNBC and says what a great company it is, and every time he says it, the stock goes up another couple of dollars.”

Carl Icahn blasted Ackman’s methods earlier this year, saying that there’s something wrong with him but that the activist investing model itself is why his fund performs so well.

Top MonaVie Income Earner from Japan Faces Tax Trouble

Akira Tamai Fails to Pay Taxes on MonaVie Income

A leading distributor in Japan for the North American network marketing company known as MonaVie, failed to report any of the income he earned from making sales of the MonaVie health products, failing to pay about ¥100 million (About $1 million in USD) in taxes, sources said.

The Tokyo Regional Taxation Bureau has reported the suspected infringement of the Income Tax Law by Akira Tamai to the Tokyo District Public Prosecutors Office, though the income has since been declared and the taxes paid, the sources said.

The 45 year old resident of Setagaya Ward, Tokyo, is the top representative among MonaVie’s 100k members in Japan and has been featured in several trade magazine features. Akira Tamai became a MonaVie rep around 2008, when he began selling juice made from acai, the fruit of an Arecaceae family plant native to Brazil, according to a person familiar with the case.

He is suspected of not reporting income or paying taxes for any of the $2.8 million he made through MonaVie from 2010 to 2012.

According to MonaVie’s Japan operations based in Minato Ward, Tokyo, members make money by buying juice at a discount from the company and selling it at a markup to friends, family and other acquaintances etc.

Members are also compensated for sales made by people in their membership group, which comprises of members they introduced, members those people introduce, and so on.

Depending on how much they sell, members are granted titles, such as “Ruby” or “Emerald,” with higher ranks such as Black Diamond, Blue Diamond, or even Crowne Black Diamond like my friend Brig Hart before he resigned from MonaVie in mid 2013.

Akira Tamai’s group reportedly has about 70,000 people, a major portion of MonaVie members in Japan.

In 2012, he was granted the company’s elite “Imperial Black Diamond” title.

He is said to be virtually guaranteed to receive an annual ¥200 million (About USA $2 Million) from his group’s sales, which he has spent on foreign luxury cars and living expenses.

“His knowledge of tax matters was lacking. He intends to properly pay his taxes in the future,” Tamai’s lawyer said.

Network marketing companies like MonaVie work by having salespeople expand their sales networks by soliciting new salespeople, which brings in profits from commission and other avenues. Also called MLM, the practice conforms with the law, unlike pyramid schemes, which are illegal.

However, there is constant pressure to invite new members to bring in profit. Solicitation methods and other aspects are regulated under “multilevel marketing” in the Specified Commercial Transactions Law. Founded in 2005 in the United States, MonaVie is now established in about 25 countries worldwide.

The Utah based health & wellness companies main product is juice made from acai and 18 other fruits. A 750-milliliter bottle sells for around ¥4,000, and MonAvie claims that drinking 120 milliliters per day is good for one’s health. The company does not have their products for sale in supermarkets or health food stores.

MonaVie began full-fledged expansion into Japan around 2008, and Tamai was an early member. He conducts 400-500 seminars per year on such topics as “The Secret to Success in Anything.” Tamai’s activities have been featured several times in multilevel marketing trade magazines.

In an interview, he said: “When you see someone cleaning a public toilet, try telling them, ‘thank you.’ When you become an honest person, it will change your appearance and people will be attracted to you.”

The company said it has provided its members with guidance on how to properly file tax returns through pamphlets, bulletins, members-only webpages and other means.

Xyngular “Tries” to Sue Innutra… Judge Says No Way Jose!

District Court Denies Xyngular’s Request for Temporary Restraining Order and Preliminary Injunction Against Innutra.

On Friday, October 25, 2013, Judge Ted Stewart of the United States Court for the District of Utah issued a written decision denying Xyngular’s request for a temporary restraining order and preliminary injunction against Innutra, LLC and Innutra’s Co-founder and CEO Jim Ayres.

Both Innutra and Ayres are extremely pleased with the court’s speedy and thoughtful decision rejecting all of Xyngular’s baseless arguments.

Judge Stewart found that Xyngular failed to establish a likelihood of success on any of its claims against Innutra and Ayres. In fact, at the hearing held on October 22, Xyngular’s attorney conceded outright that the company did not have evidence to support its claims that either Innutra or Ayres had misappropriated or duplicated Xyngular’s product formulations.

The court’s written decision noted that Xyngular’s claim that Innutra, Ayres, and other former Xyngular employees and distributors improperly had misappropriated distributor information also was not supported by any evidence.

innutra lawsuitThe court rejected Xyngular’s claim that Ayres breached his agreement with Xyngular when he developed the Innutra product line; the court also found that Xyngular had failed to show a likelihood of success on its claim that Ayres had violated a purported non-compete agreement. Finally, the court rejected Xyngular’s false advertising claim against Innutra, noting that Xyngular was “unable to affirmatively link any of the alleged false statements” to Innutra.

“We are not surprised by the ruling denying the TRO and preliminary injunction motion filed by Xyngular,” said Jim Ayres.

He added “The court’s ruling confirms the complete lack of merit to the claims that Xyngular brought against Innutra, me, and other former Xyngular employees and distributors for the sole purpose of interfering with Innutra’s success.

We have complete faith that our legal team ultimately will prevail in the courtroom and defeat Xyngular’s baseless lawsuit. Ocean Avenue vs. ViSalus Lawsuit 2013: This is MLM Not Burn Notice!

Who’s Lying: Ocean Avenue or Visalus?

Troy Dooly of the MLM Help Desk broke the story, providing all the legal info as well as photos and screen shots as evidence. Ocean Avenue, Ken Dunn and others claim that ViSalus took part in RICO and allegedly hired 3rd party individuals to take part in extortion and other criminal acts.

Visalus is accused of not only engaging in corporate espionage, but computer hacking and theft to damage Ocean Avenue and its owners according to the allegations.

They also hired hackers to gain access to Ocean Avenue corporate leaders email and Facebook accounts, and attempted to sue former ViSalus leaders who have left the company for Ocean Avenue… don’t we live in America?

The funniest part about this whole lawsuit is the way top ViSalus “leaders” handled the situation when people started exercising their right to free speech… take a look below:

Legal Shield: Can You Earn Income?

Obviously Legal Shield is a legit company as they have been in business for over 40 years, so yes you can succeed and yes they will send you a check month after month IF you put in the time and effort to actually learn how to build a Legal Shield business.

Herbalife: Work From Home Claims and FTC Controversy

herbalife ftcIn an article posted on the NY Times this week, Herbalife is in the limelight yet again… and not for positive press.

The FTC has received over 100 complaints from people who invested money in companies that marketed home business opportunities, only to find out later on that they were being asked to join Herbalife’s marketing arm and sell its products.

The people who invested money with these third party companies also had trouble getting refunds.

FTC Controversy

On the Business For Home official website, Ted stated that this is the second set of complaints filed against Herbalife to the FTC. This will obviously raise a red flag and more questions about their ethics and business practices.

Third party companies that promote work from home type opportunities could be a new source of scrutiny for Herbalife, the nutritional products company that has become the subject of a massive battle on Wall Street.

The FTC has received multiple complaints from people who have paid money to companies like Income At Home and Online Business Systems, according to materials the agency released under the Freedom of Information Act.

In a lot of these complaints, customers who contacted such companies said they found out later on in the process that they were being recruited to sell Herbalife products, an opportunity many were not looking to do.

“For a company of our size, we have had a relatively low number of complaints to the F.T.C,” Julian Cacchioli, a company spokesman, said in an e-mail.

Cacchioli also stated that work from home programs, “do not work on behalf of Herbalife and the practices are not condoned or encouraged by Herbalife.”

 greatest networker in the worldAre you an online or network marketer who has been recently contacted by a guy named Gordon Moss? Gordon is claiming to the be the author of the “Greatest Networker In The World” and has supposedly been around network marketing for over four decades!

Now although I haven’t been around MLM for 40 years because I am only 21 years old, I have been around long enough to know that the author of “The Greatest Networker In The World” is a guy by the name of John Milton Fogg.

So as soon as this “Gordo” or Gordon Moss character started throwing out these lavish claims about how he is the highest paid network marketer alive, the top recruiter in Numis Network and even my own network marketing company EPX Body, I knew the guy was full of shit. He even claims to have “taught David Wood everything he knows.”

Is Gordon Moss a Con Artist?

Now after hearing this Gordon Moss guys claims of being the highest paid this, top recruiter that, although I knew he was full of shit I just wanted to keep listening to see what the heck this guy was actually going to pitch me. The first tell tale sign that he is a scam artist is the fact that his voice is disguised through the phone. It almost sounds like he has been smoking for 100 years, but after hearing how sketchy this guys business model is I am near certain he uses a voice changer.

Gordon will go on to tell you that you have no idea what you are doing, your company sucks and that you aren’t even doing it right. (Wait a minute, didn’t he JUST tell me he was a top recruiter in my MLM?) He says there is no money in network marketing, and uses analogies to show you that the person who learns how to recruit ‘heavy hitters’ who already have thousands of people in their down line will make the most money.

What is Gordon Moss Selling?

gordon mossSo after listening to this guy mumble around for over an hour, he finally sends me to a website about $100 drop cards. Great idea! Buy generic drop cards that look like a $100 bill folded in half, and when they open it up they get a pitch for an opportunity with your contact information. Actually seems like a great idea that might help me generate some local leads, I was somewhat interested in purchasing a box of these $100 drop cards.

Gordon went on to say that he sells these cards to Mexican Drug Cartel, Brothels, and other people who can use these $100 drop cards to recruit new gang members, hookers etc. After he said this I knew the guy was either running an illegal operation or trying to get me caught up somehow.

Here is where it gets very shady…

Gordon says that he doesn’t deal in checks or credit cards when selling his infamous $100 drop cards. You must overnight $425 cash directly to his house or use Western Union. Huge red flag.

A simple Google search for “Gordon Moss” comes up with many complaints on the official Rip Off Report site.

Another article about the Gordon Moss Scam was written by a fellow network marketer named Andrew Murray.

Everybody has basically had the same experience with this dumb ass from what I can find. I wanted to put a picture of him on this article but he is so sneaky he doesn’t have a personal blog or website even though he is “the highest paid network marketer alive” and “top recruiter in every company under the sun.”

I hope this article will save you time and money in the future if you get a phone call from the “World’s Greatest Networker” Gordon Moss!

My Radio Interview w/ Syndicated News about MonaVie Case

Hey everyone, Joe here with a quick video of a recent interview I did with Syndicated News.

I was contacted by a reporter from this news site and she wanted to do a brief interview about a case in court involving leading health and nutrition MLM company, Mona Vie and one of their top income earning distributors.

Judge says “NO” to MonaVie about stopping former distributor Joe Licciardi from posting statuses about his new home business on FaceBook.

MonaVie just lost a devastating landmark case. Joe Licciardi agreed to sell the Monavie in exchange for specific commissions based on his amount of sales. Once the sales were made however, Mona Vie changed the rules.

Disillusioned, Former MonaVie Black Diamond Joe Licciardi began promoting an additional MLM and posted his messages on Facebook.

Monavie responded by suing him and the case wound up before U.S. District Judge Clark Waddoups, who in a landmark decision ruled that Monavie’s expectations of its independent distributors is too broad and vague and unenforceable.

The ruling caused many more of Monavie’s “Black Diamond independent sales force to abandon ship.

A lot of their former 7 figure distributors left Mona Vie to promote competing health and wellness MLM companies such as Visalus, Jeunesse, EPX Body, and many more.

Are MonaVie Leaders Earnings On A Downward Spiral?

So if you have found yourself on this webpage then you were probably searching around Google for some information about MonaVie leaders and how much they are earning per year. There used to be well over 100+ MonaVie distributors earning the million dollar per year mark. But in an updated chart for the top earners in network marketing, it looks like the leaders have dropped from being in the top 10.

About a year ago when I checked the top income earners hall of fame, it looked something like this:

Okay so this chart was from about a year ago or so.

As you can see, MonaVie leaders were covering the charts top 25. These were the only numbers available on the internet that I could find, and these were also identical to the numbers that my beloved MonaVie distributors have told me they were earning.

Now lets get to the juicy stuff…

For those of us serious network marketers out there, most of us read Business For Home’s website with the up to date news and controversies going on in our industry. So today I was reading my morning news, and saw that the creator of Business For Home, Ted Nuyten had posted an up to date list of top earners as of August-September 2012. Take a look at this chart and see what has changed:

It seems as though the former MonaVie top guy Brig Hart took a pay cut of over $10 million dollars… He seems to be doing other things though, like writing new books, starting new companies and maintaining his other companies like Salt Life and recently his son opened up a sunglasses company called WISDOM.

Brig was retired since his Amway run in the 80’s-90’s, he’ll be okay…

Here is my take on the whole situation as I have been watching this unfold for years now…

Earlier this year, MonaVie decided to make Randy Schroeder the president of North America for MonaVie. He sent out some harsh, almost communist memos to distributors signalling that they need to make a decision… Build MonaVie and that is that. No other network marketing companies allowed, and no affiliate programs.

This caused thousands of distributors even high ranking MonaVie Black Diamond‘s to abandon the sinking ship. With the rules being changed as so, MonaVie distributors were only able to use their new ‘unified’ MVP training system created by Randy Schroeder himself. Although the tactics are out of date seeming similar to audio cassettes from Amway functions back in 1960, let them learn the hard way…

You see, most of MonaVie’s top income earners were using an affiliate program to help them generate qualified leads for MonaVie, and additional cash flow to fund their advertising and marketing budget for Monavie. So once ol’ Dictactor Schroeder pulled the plug on affiliate programs to implement his socialist form of ‘buy our system and our system only’ type of crap, a lot of MonaVie Black Diamond leaders jumped ship to other, more open minded network marketing companies.

This obviously decreased the amount of cases of MonaVie juice on their bigger and smaller legs, causing their incomes to decline sharply. They are trying to even out the losses by lowering costs and adding more points or something to their EMV energy drink line (great stuff by the way)

Will these tactics save the company or has MonaVie reached their peak?

SEC Shuts Down Zeek Rewards: Calls It A $600 Million Dollar Ponzi Scheme

The rumors are true my friends… The SEC came down hard on Zeek Rewards on August 16th 2012 by shutting down their operation. They came to find out that Zeek Rewards was actually a pyramid/ponzi scheme that was made to look like a penny auction site, being marketed through a word of mouth business model.

The CEO and President of Zeek Rewards Paul Burks has neither confirmed or denied the charges brought against him and his company, yet he has agreed to pay a hefty $4 million dollar penalty to the SEC.

The courts have appointed a lawyer to represent the people who were scammed by the company, and is working on managing the remaining assets and paying them back out to the distributors.

The company still apparently has over $225 million of investor funds being held in 15 foreign bank accounts. The fact that much money was held in 15 seperate banks, all in FOREIGN countries should give a clue of what was going on there… But I am sure the distributors who got scammed by this had no idea it was all being held overseas.

The real shocker here was just a few days after being shut down in the United States news surfaced that Zeek Rewards was planning on opening up all over again in Europe. This will most definitely stir a problem, as Europe is almost always stricter on multi level marketing companies than the United States.

We will see how this plays out… I just feel bad for all the families who left their full time career to pursue this Zeek thing full time. Hopefully they get some of their invested funds back and can find work or a new marketing opportunity.

I was reading the Salt Lake Tribune the other day because a former MonaVie Black Diamond that I am friends with on Facebook, shared the link on his public Facebook wall. I read the article and did some more research about what was going on over at MonaVie.

Come to find out, Mon a Vie was in court last week with a former top income earner (ranked 30th in overall commissions) who is former Black Diamond Joe Licciardi, and they sued him because he posted some stuff on his Facebook wall about the new network marketing business he is promoting called Momentis Energy.

The Salt Lake U.S District Judge Waddoups threw out MonaVie’s case against former Black Diamond Joe Licciardi. The judge said that “MonaVie of South Jordan had failed to show that Joseph Licciardi had likely violated policies of the company, which markets a nutritional fruit juice and weight-loss products to a network of independent distributors.”

Licciardi and his wife left MonaVie late last year to start promoting up and coming multi-level marketing energy company called Momentis Energy. In a recent interview with Business for Home, Joe stated this:

“We have come to realize that no matter how good a product is, and in a suffering economy like we are in today, it is extremely difficult to get people to change their buying habits, outside of their basic needs, because the moment they run into financial hardship, many will stop ordering that product.” Says Licciardi.

“The challenge of trying to grow, or even just maintain their auto-ship can become next to impossible. So for us to find a network marketing company that has an essential product or service which every household must maintain, was beyond attractive.” Says Joe.

I want to wish Joe the best of luck at his new company Momentis. Previously Monavie CEO Dallin Larsen said distributors of MonaVie are free to leave MonaVie at anytime to pursue other companies, but that does not seem apparent after seeing the company sue a former distributor this week.

Be careful Mr. Larsen, suing a former distributor over free speech is a touchy subject. You might offend conservative Americans and Mon a Vie distributors who feel that as American’s we are able to say what we want, whenever we want. And we damn right aren’t gonna change that fact to push your acai berry juice.
